Abstract
This study provides an 18th chapter perspective on the impact of congressional decisions on the criminal justice system, specifically in relation to prosecutors, unions, and junior outside prospective shades. Through an analysis of historical documents and contemporary cases, the authors demonstrate how political errors made by Congress have contributed to systemic issues within the criminal justice system, including the overuse of prosecutorial discretion, the lack of union protections for public defenders, and the underrepresentation of diverse perspectives in the legal profession. The authors argue that addressing these issues requires a comprehensive reevaluation of the policy decisions that have led to their emergence, as well as a commitment to enacting meaningful reforms that prioritize the needs of all stakeholders within the criminal justice system. Ultimately, this study highlights the importance of recognizing the ways in which political decisions can shape the criminal justice landscape, and the need for continued engagement and advocacy to ensure that the system is equitable and just for all who interact with it.
